    Edward “Ed” Burbach chairs Foley & Lardner’s Government Solutions Practice Group, co-chairs Foley’s State Attorneys General and FTC Consumer Practices, and is managing partner of the Austin office.

    Ed leverages his experience as both a litigation lawyer and a leading state regulator/enforcer to handle high-stakes regulatory claims for clients. With this unique background, he counsels corporations, individuals, and governmental entities in matters involving local, state, and federal governments – with emphasis on state attorneys general and the Federal Trade Commission (FTC). He and his team members maintain strong relationships with all state attorneys general and their staffs and regularly attend major NAAG, AGA, RAGA, & DAGA state attorneys general meetings. Most recently, Ed led an interdisciplinary Foley team throughout a 7 ½ year investigation (3 1/2 years) and litigation (4 years in Chicago, Trenton, & Dallas federal courts) resulting in a complete September, 28, 2023, federal trial court victory in FTC v. Neora which the media has labeled as “Historic”. Am Law honored Ed by naming him and two other Foley trial partners as “Litigators of the Week” in the U.S. (October 6, 2023).

    Over the past three decades Ed has handled Unfair & Deceptive Acts and Practices (UDAP), Medicaid fraud, FTC, price gouging, FOIA/State Public Information Act litigation, and attorney general opinions. He has advised clients on strategy and programs related to environmental, social, and governance (ESG)- related issues and transactions, including, but not limited to state anti-boycott statutes.     Adolfo Franco is Executive Vice President at the Direct Selling Association, responsible for managing and directing the government relations efforts for the association in Washington, DC and throughout the United States. Appointed by President Bush in 2001, and confirmed by the United States in 2002, Adolfo managed and directed the $1.5 billion annual U.S. foreign assistance program for Latin America and the Caribbean and worked to negotiate and implement the Central American and Dominican Republic Free Trade Agreement (CAFTA). Adolfo was one of the Bush Administration’s key policymakers, advising the President, Secretary of State, and USAID Administrator on issues involving Cuba, Colombia, Haiti, and Venezuela. Adolfo has met with most of Latin America’s Presidents, Foreign Ministers, and Trade Representatives and has represented the United States as Head of Delegation at numerous bi- and multilateral forums.

    Peter C. Marinello is a Vice President at BBB National Programs. In this role, he serves as Director of BBB National Programs' Direct Selling Self-Regulatory Council (DSSRC), a national advertising self-regulation program for the direct selling industry.

    Mr. Marinello has over 25 years of experience in advertising self-regulation, starting as a staff attorney at the Council of Better Business Bureaus—now BBB National Programs—National Advertising Division (NAD) in March of 1993, and later becoming NAD Associate Director in 1998.

    Mr. Marinello has written over 1,500 self-regulatory decisions on various advertising topics and products including earnings claims, online advertising, negative option offers, dietary supplements, nuclear energy, and financial services, and has spoken on behalf advertising self-regulation at trade conferences and workshop seminars throughout the country.

    He has also authored a number of articles regarding advertising self-regulation in various trade publications. Prior to joining BBB National Programs, Mr. Marinello practiced law for six years at a general litigation firm in New York City.

    He has appeared in court in each of the five boroughs of New York, as well as Nassau and Suffolk counties, and is also admitted to New York’s Southern and Eastern District Courts of the United States.

    Mr. Marinello received his bachelor's degree at New York University and is a graduate of St. John's University School of Law. Mr. Marinello has been a member of the New York State Bar since 1988.

From its inception, Truth in Advertising (TINA.org) has worked to expose brazen falsehoods in marketing for what they are, whether it’s fly-by-night operations hawking obscure products or the marketing activities of the nation’s largest corporations. TINA.org’s work has uncovered deceptive practices and false advertising that often target vulnerable consumers, from senior citizens to parents of children with disabilities to families in economic distress.

    Bonnie provides the overall vision, leadership, and direction to help TINA.org achieve its mission and strategic goals. Her commitment to educating the public about deceptive marketing and fraudulent ads stems from her belief that education is the only viable way to effectively eradicate the market of false ads.

    Since launching TINA.org, the organization has filed more than 200 legal actions, published more than 1,000 ad alerts, written over 800 news articles, and tracked more than 2,000 federal class actions alleging deceptive marketing. Since 2015, state and federal agencies have fined companies more than $250 million based on TINA.org legal actions, and returned millions in ill-gotten gains to consumers.

    Bonnie has testified before Congress on issues related to consumer protection, deceptive marketing and economic justice. She is a regular commentator in the media including appearances on NBC, CBS, ABC, BBC, and CBC, in publications including The New York Times, The Wall Street Journal, The Washington Post, USA Today, The Atlantic, The Economist, Los Angeles Times and The Boston Globe, and on podcasts such as The Dream.

    Bonnie is the recipient of the 2019 Florence Kelley Consumer Leadership Award from the National Consumers League (NCL) for her work fighting false and deceptive advertising.

    Prior to helping found TINA.org, she spent most of two decades working as a litigation attorney in New Haven, CT. She earned her J.D. from Boston University and her B.A. from the University of Pennsylvania.

    Prior to joining DSSRC, Howard was a commercial counselor and litigator in private practice handling complex matters across a broad array of subject matters including false advertising disputes, intellectual property, and bankruptcy matters.

    Howard has substantial first and second chair trial experience as well as experience counselling a wide variety of commercial clients. Howard’s notable achievements for varied clients include successfully arguing an appeal to the Second Circuit for a Fortune 200 client, winning two breach of contract trials in New York state court, winning a defense verdict in a two-week jury trial in California state court, obtaining dismissal of all claims against his client in a “bet the company” advertising and trademark dispute, and favorably resolving as co-counsel seven litigations arising from real estate investments in excess of $1 billion.

    Howard also has significant experience in advertising disputes before the National Advertising Division (NAD) of BBB National Programs and with consumer perception surveys in both NAD and Lanham Act matters. In addition to his work at DSSRC, Howard has also handled matters brought before NAD.
